Real Estate and Land Use Practice

Hoeppner Wagner & Evans real estate attorneys have represented area developers and commercial entities, as well as individual investors, in commercial and residential real estate development projects and related financing and land use/municipal matters. Our work has involved us in multi-unit residential development projects for both single-family and multi-family occupancy, as well as mixed-use commercial development projects. Our work in this area has included:

Land Use and Planned Unit Developments (PUD). We have worked with a number of area developers on projects involving multi-site acquisitions or sales, as well as single-site purchases or sales. As an example, we represented the developer of a rural 100-lot single-family home subdivision before state and municipal agencies in the approval of a constructed wetland plan for the subdivision's waste system. This type of waste system has been used successfully at Disney's EPCOT theme park for many years. The plan was approved and the developer proceeded with construction. We also represent a Chicago-area developer who is developing an approximately 100-acre parcel in Northwest Indiana for one-acre, high-end residential properties. We represent the developer of a PUD project that contains plans for the construction of town center, commercial office and restaurant facilities, condominiums, cottage homes, single-family homes, and an 18-hole golf course. To date, we have completed the zoning and platting for the project and are engaged in the leasing for the commercial properties.

Site Acquisition/Sale. In addition to our work in the area of multi-unit and planned unit development, Hoeppner Wagner & Evans attorneys have been retained to assist entities in the acquisition or disposition of property. As an example, we have represented a discount grocery chain in acquisitions involving approximately 40 stores in Northwest Indiana, Southeast Chicago and Western Michigan. We also represent a family-owned gas station and convenience mart chain and have assisted this client in developing or acquiring 42 store facilities across Northwest Indiana. In both client examples, our firm was also responsible for environmental due diligence work related to the properties.

Leasing. Our work in the area of leasing has involved both commercial and residential properties. For commercial properties, we have handled lease drafting, negotiation and review matters for office buildings, mixed-use properties, shopping centers and condominiums. As an example, we wrote and negotiated the leases for the developer of a historic building conversion into a mixed-use space for a financial institution, restaurant, retail shops and professional offices. With respect to our work for residential properties, we have written leases for apartment buildings and single-unit residential homes.

Financing. We have been involved in the financing of real estate projects from both the buyer and financial institution side of the transaction. In addition, our bank clients use the firm to structure complicated asset-based loans, which often involve real estate assets.

Municipality/Government Representation. Our real estate attorneys have also been retained over the years to represent area municipalities, townships and school districts including the Towns of Demotte, Kouts and Lowell.
