Site Acquisition And Sales

Hoeppner Wagner & Evans LLP lawyers have assisted individuals and all types of business entities with acquiring and disposing of real estate. For example, we have represented a national grocery chain for the acquisition of approximately 125 stores in the Northwest Indiana region and beyond. We have also represented a family-owned gas station and convenience mart chain for the acquisition and development of store locations. The firm has also represented a homeowners association that acquired a community 18-hole championship golf course from the original developer.


Our work with clients includes the leasing of real estate, including both commercial and residential properties. On the commercial side, we have handled lease contract drafting and negotiation and review matters for shopping centers, office buildings, mixed-use properties and condominiums. We wrote and negotiated leases for the developer of a historic building conversion into mixed-used space for a restaurant, a financial institution, retail shops and professional offices. During our work for residential properties, we have prepared standardized leases for apartment buildings as well as single-unit residential homes in Northwest Indiana.

Land Use And Zoning

The firm has a very active land use and zoning permit practice in all communities within Northwest Indiana, including cities and towns as well as the unincorporated areas of each of the counties. This practice includes zone change (rezoning), petitions, use and development zoning variances, special use permits and other zoning approvals and permits. We have represented homeowners who wish to make and improve their homes that require approval as well as national companies locating to Northwest Indiana. Our land use practice includes preparing planned unit development (PUD) project documents for mixed-use and complex site developments as well as written zoning commitments. The zoning practice also includes the platting and permitting for residential, commercial and mixed-use subdivisions before state and municipal agencies.


The firm has been involved in the financing of real estate projects from both buyer and the financial institution lender’s side of the transaction. For banking clients, we structure complex asset-based loans that often involve real estate assets.

Municipal/Government Representation

Our real estate practice lawyers have been retained to represent municipalities, townships and school districts in continuing routine representation as well as special counsel for complex and unique matters. The firm has represented the towns of DeMotte, Kouts and Lowell on a continuing basis in its history.
